PLEASE READ THESE TERMS OF USE CAREFULLY. THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND CYBERACTIVE, INC., DOING BUSINESS AS GETDEFENSIVE.COM.
By accessing GetDefensive.com, creating an account, registering for a course, clicking an "Accept," "I Agree," or similar button, or otherwise using our website, online courses, applications, products, or services, you acknowledge that you have read, understood, and agree to these Terms of Use.
If you do not agree to these Terms, you should not access or use our services.
Certain courses may be subject to additional state-specific enrollment agreements, disclosures, policies, or regulatory requirements. If a state-specific requirement conflicts with these general Terms, the applicable state-required provision will control with respect to that course.

GetDefensive.com ("Get Defensive," "GD," "we," "us," or "our") is operated by CyberActive, Inc. We provide online driver education, defensive driving, traffic safety, and related educational services.

Course availability, approval status, eligibility requirements, course length, testing requirements, certificate procedures, and other requirements may vary by state, jurisdiction, court, or course.
2. Eligibility and Student Registration
When registering for a course or creating an account, you agree to provide true, accurate, current, and complete information.
You are responsible for promptly correcting or updating your information if it changes.
You may not create an account using another person's identity or permit another person to complete a course, examination, identity-validation requirement, or other required activity on your behalf.
If you are under the age of majority in your state, your parent or legal guardian may be required to review and consent to these Terms and any applicable enrollment agreement.
We may suspend or terminate an account if we reasonably believe that information provided during registration is false, inaccurate, fraudulent, incomplete, or being used to circumvent course or regulatory requirements.
3. Student Account and Password Security
You are responsible for maintaining the confidentiality of your username, password, security questions, authentication credentials, and other account information.
You are responsible for activity conducted through your account.
You agree to notify Get Defensive promptly if you become aware of unauthorized access to your account, unauthorized use of your credentials, or another suspected security breach.
Accounts are personal to the registered student and may not be transferred, shared, sold, or assigned to another person.
4. Course Security, Identity Validation, and Academic Integrity
State-approved courses may contain security and identity-validation measures required by law, regulation, licensing agencies, courts, or other governmental authorities.
The registered student must personally complete all required course activities unless applicable law or an approved accommodation provides otherwise.
You may not:
- Have another person complete any portion of a course for you;
- Complete a course or examination for another student;
- Provide false identification or registration information;
- Circumvent or attempt to circumvent course timers;
- Bypass identity-validation or security questions;
- Manipulate course progress or completion records;
- Use scripts, bots, automated tools, artificial intelligence, or other technology to complete required student coursework or examinations on your behalf;
- Copy or distribute examination questions or security questions;
- Falsify documents or completion information;
- Alter or attempt to alter a Certificate of Completion; or
- Otherwise misrepresent your participation in or completion of a course.
Falsification of documents submitted to a court or government agency may constitute a criminal offense.
If we reasonably determine that a student has cheated, misrepresented his or her identity, falsified information, or attempted to circumvent required security measures, we may suspend or terminate the student's course without a refund where permitted by law.
We may also invalidate or withhold a Certificate of Completion and report suspected misconduct to an applicable court, licensing agency, governmental authority, or law-enforcement agency when required or permitted by law.
5. Course Requirements
Students are responsible for satisfying all requirements applicable to the course in which they enroll.
Requirements may include:
- Minimum instructional time;
- Chapter or page timers;
- Unit examinations;
- Final examinations;
- Minimum passing scores;
- Identity-validation questions;
- Security questions;
- Attendance requirements;
- Affidavits or Statements of Assurance;
- Eligibility verification;
- Government database verification; and
- Other state- or jurisdiction-required procedures.
Course-specific requirements presented during registration or within the course are incorporated into these Terms by reference.
Students will not receive course completion credit unless all applicable requirements have been satisfied.
6. Timers and Required Instructional Time
When a course is subject to minimum instructional-time requirements, students must satisfy all required timers.
Students may not circumvent, disable, manipulate, accelerate, or otherwise interfere with course timers.
Leaving a course page before its required instructional time has elapsed may result in the student not receiving credit for that portion of the course.
7. Examinations and Grading
Passing-score requirements and examination procedures vary by course and jurisdiction.
Students are responsible for reviewing the grading and completion requirements displayed for their specific course.
Where required, a student who does not achieve the minimum passing score may be required to review or repeat instructional material before attempting another examination.
The number of examination attempts may be limited by applicable state requirements.
8. Course Availability and Technology
We strive to make our online services available on a reliable basis. However, we do not guarantee uninterrupted access.
Access may occasionally be unavailable because of scheduled maintenance, system upgrades, internet outages, third-party service interruptions, telecommunications failures, cybersecurity events, governmental actions, circumstances beyond our reasonable control, or other technical issues.
Students are responsible for maintaining:
- A compatible computer, smartphone, or tablet;
- A supported and reasonably current web browser;
- Reliable internet access;
- A valid email address;
- Any audio, camera, or other hardware required by the applicable course; and
- Any additional technology identified during registration.
We may update technical requirements as technology and regulatory requirements change.
9. Fees and Payment
The price applicable to a course will be displayed during registration or checkout.
By submitting payment information, you authorize Get Defensive and its payment processors to charge the applicable fees, taxes, and any optional products or services you affirmatively select.
Additional fees may apply to optional services such as expedited processing, expedited delivery, duplicate certificates, additional products, or other upgrades.
All applicable fees will be disclosed before the applicable purchase is completed.
We reserve the right to change pricing for future purchases at any time. A pricing change will not retroactively change the amount already paid for a completed purchase except where required by law.
10. Refund and Cancellation Policy
Refund eligibility is determined by the refund policy presented for the specific course and any applicable state requirements.
For courses subject to a state-mandated cancellation or refund policy, that policy controls.
Unless otherwise required by law or expressly stated in the applicable course enrollment agreement, fees may become nonrefundable after specified course milestones have been reached, including attempting a final examination, completing the course, receiving a certificate, or expiration of the enrollment period.
Any approved refund will be returned using the original payment method when reasonably possible.
11. Course Expiration
Course access may expire after the period disclosed during registration or required by applicable law.
If a student does not complete a course before the applicable expiration date, the enrollment may terminate and the student may be required to register and pay again to restart the course.
Any state-specific expiration and refund requirements will control over this section.
12. Certificates of Completion
Certificates of Completion are issued only after a student has successfully satisfied all applicable course requirements.
Get Defensive will not knowingly issue a Certificate of Completion to a student who has not completed the requirements established for the course.
Certificate delivery methods vary depending on the course and jurisdiction and may include electronic delivery, direct reporting to a government agency or court, physical delivery, or another approved method.
Students are responsible for providing accurate information for certificates and regulatory reporting.
A student should promptly contact us if information appearing on a certificate is incorrect.
Fees may apply for replacement or duplicate certificates where permitted by applicable law.
13. No Guarantee of Ticket Dismissal, License, Insurance Discount, or Government Action
Completing a Get Defensive course does not guarantee:
- Dismissal of a traffic citation;
- Reduction of a fine or penalty;
- Removal of points from a driving record;
- Issuance of a driver's license or permit;
- Acceptance of a certificate by a particular court or agency;
- An automobile insurance discount;
- Reduction of an insurance premium; or
- Any particular action or result from a court, insurance company, licensing authority, or governmental agency.
Eligibility and acceptance are determined by the applicable court, government agency, insurance company, or other authority.
Students are responsible for confirming their eligibility before enrolling when eligibility depends upon a court, licensing authority, or other third party.
14. Third-Party and Government Data
Certain courses may require Get Defensive to verify student information using governmental, public, or authorized third-party databases.
By enrolling in a course that requires such verification, you authorize us to obtain and use the information reasonably necessary to verify your identity, eligibility, course participation, or completion.
Information may also be reported to courts, state agencies, licensing authorities, regulatory agencies, or other entities when required to administer or report completion of the applicable course.
Our collection and use of personal information is further described in our Privacy Policy.
15. Privacy
Your use of our services is subject to the GetDefensive.com Privacy Policy.
The Privacy Policy describes how CyberActive, Inc. collects, uses, stores, protects, and discloses personal information.
By using our services, you acknowledge that you have had an opportunity to review our Privacy Policy.
16. Intellectual Property
All content made available through GetDefensive.com and our courses is owned by or licensed to CyberActive, Inc. and is protected by applicable copyright, trademark, trade-secret, and other intellectual-property laws.
Protected content includes, without limitation:
- Course text;
- Examination and quiz questions;
- Graphics;
- Photographs;
- Illustrations;
- Videos;
- Audio;
- Animations;
- Software;
- Source code;
- Website designs;
- Databases;
- Logos;
- Trademarks;
- Course organization and presentation; and
- Other educational and proprietary materials.
Except as expressly permitted by us in writing, you may not copy, reproduce, publish, distribute, transmit, display, sell, license, modify, create derivative works from, scrape, download in bulk, reverse engineer, or commercially exploit our content.
17. Limited License
Subject to your compliance with these Terms, CyberActive, Inc. grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the applicable website and course solely for your own legitimate educational purposes.
No ownership rights are transferred to you.
This license terminates when your course access expires or is terminated or when you violate these Terms.
18. Prohibited Uses
You may not use GetDefensive.com or its services to:
- Violate any applicable law or regulation;
- Commit fraud or impersonate another person;
- Interfere with website or course security;
- Gain unauthorized access to systems or accounts;
- Introduce viruses, malware, or malicious code;
- Scrape, crawl, harvest, or systematically extract course content without authorization;
- Copy or create competing educational materials from our proprietary content;
- Resell course access;
- Share accounts or credentials;
- Reverse engineer software or security systems;
- Interfere with another student's use of the service; or
- Use the service in any manner that could damage CyberActive, Inc., Get Defensive, our systems, or our users.
19. Suspension and Termination
We may suspend, restrict, or terminate access to our services when we reasonably believe a user:
- Violated these Terms;
- Violated applicable law or regulatory requirements;
- Engaged in fraud or cheating;
- Circumvented security requirements;
- Created a security risk;
- Failed to pay applicable fees; or
- Used the service in a manner that could harm Get Defensive, CyberActive, Inc., another user, or a third party.
Termination does not affect obligations or rights that by their nature should survive termination, including intellectual-property rights, disclaimers, limitations of liability, payment obligations, and dispute provisions.
20. Third-Party Services and Links
Our websites or courses may contain links to or integrations with third-party websites, payment processors, government agencies, mapping services, authentication providers, or other third-party services.
We do not control third-party services and are not responsible for their content, availability, security, privacy practices, policies, or actions.
The inclusion of a third-party link does not necessarily constitute our endorsement of that third party.
21. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETDEFENSIVE.COM, CYBERACTIVE, INC., AND THEIR SERVICES, WEBSITES, SOFTWARE, AND COURSE MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
EXCEPT FOR WARRANTIES THAT CANNOT LEGALLY BE DISCLAIMED, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND FITNESS FOR A PARTICULAR RESULT.
WE DO NOT WARRANT THAT OUR WEBSITE OR SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
Nothing in this section limits any warranty or consumer right that cannot lawfully be waived.
22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBERACTIVE, INC., GETDEFENSIVE.COM, AND THEIR OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, OUR SERVICES.
THIS INCLUDES, WITHOUT LIMITATION, LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF COURSE PROGRESS, MISSED DEADLINES, COURT CONSEQUENCES, OR OTHER LOSSES RESULTING FROM EVENTS OUTSIDE OUR REASONABLE CONTROL.
TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR COURSE OR TRANSACTION WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THAT COURSE OR TRANSACTION.
Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, these limitations apply only to the extent permitted by law.
23. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless CyberActive, Inc., GetDefensive.com, and their officers, directors, employees, contractors, affiliates, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of our services, your violation of these Terms, your infringement of another person's rights, or fraud or misconduct committed through your account.
24. Governing Law
Except where applicable law requires otherwise, these Terms will be governed by the laws of the State of California, without regard to its conflict-of-law principles.
Any state-specific course requirements or mandatory regulatory provisions will continue to apply regardless of this section.
25. Dispute Resolution
Before initiating formal legal proceedings, you and CyberActive, Inc. agree to make a reasonable good-faith effort to resolve disputes informally.
A party seeking to raise a dispute should provide written notice describing the nature of the dispute and the requested resolution.
Nothing in this section prevents either party from seeking relief in small claims court where eligible or from exercising rights that cannot legally be waived.
IMPORTANT: Any arbitration agreement, jury-trial waiver, or class-action waiver should be separately reviewed and approved by CyberActive, Inc.'s legal counsel before being incorporated into these Terms.
26. Chargebacks and Payment Disputes
If you believe a charge is incorrect, we encourage you to contact us before initiating a chargeback so that we have an opportunity to investigate and resolve the issue.
Initiating a chargeback does not eliminate payment obligations for valid purchases.
Any chargeback or administrative fee imposed on a student must be permitted by applicable law and must have been properly disclosed before purchase.
27. Accessibility and Accommodations
We seek to make our online educational services accessible to students.
Students who require an accommodation should contact us so that we can determine what accommodations are available or required under applicable law and course regulations.
Certain accommodations may require approval or documentation when mandated by a licensing or regulatory agency.
28. Changes to Courses and Services
We may update our websites, technology, course presentation, features, policies, or services from time to time.
State-approved course content and regulatory requirements will be changed only as permitted or required by the applicable regulatory authority.
We may discontinue a product or service, subject to applicable laws and our obligations to currently enrolled students.
29. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, technology, business practices, or legal requirements.
When material changes are made, we will update the "Last Updated" date and provide any additional notice required by law.
Your continued use of our services after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
Changes will not retroactively eliminate rights that cannot legally be waived.
30. Entire Agreement
These Terms, together with any applicable enrollment agreement, course-specific disclosures, Privacy Policy, refund policy, and state-required documents, constitute the agreement governing your use of the applicable services.
Verbal statements or promises that conflict with these written terms do not modify this agreement unless confirmed in writing by an authorized representative of CyberActive, Inc.
31. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
32. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
33. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
CyberActive, Inc. may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar business transaction, subject to applicable law.
34. Regulatory Requirements
Nothing in these Terms is intended to override a requirement imposed by a state licensing authority, court, governmental agency, or other regulatory authority governing a particular course.
Where applicable regulations require specific disclosures, refund policies, instructional procedures, validation procedures, course-completion requirements, grievance procedures, or other provisions, those requirements are incorporated into the applicable student's enrollment agreement.
35. Grievances and Complaints
Students with a complaint regarding a Get Defensive course should first contact Get Defensive so that we have an opportunity to resolve the matter.
Some state-approved courses provide students with the right to submit unresolved complaints to the governmental agency responsible for regulating the course. Applicable agency contact information will be provided in the student's course materials or enrollment agreement when required.

Texas Course-Specific Provisions
Students enrolled in a Texas-regulated course may be subject to additional requirements established by the Texas Department of Licensing and Regulation ("TDLR") or another applicable Texas authority.
These requirements may include minimum instructional time, identity validation, security questions, examination requirements, certificate procedures, recordkeeping requirements, refund requirements, and student grievance procedures.
The Texas enrollment agreement and course disclosures presented to the student during registration are incorporated into these Terms.
If a Texas regulatory requirement conflicts with a general provision of these Terms, the applicable Texas requirement will control.
Student Acknowledgment
By registering for and participating in the course, the student acknowledges that the student has been provided access to applicable tuition and fee information, cancellation and refund policies, course requirements, grading and progress policies, rules of conduct, technology requirements, and any disclosures required by the applicable regulatory authority.
